Terms of Service

Short version: buy bath bombs, we ship them, and if anything goes wrong we make it right. The longer version is below.

1. Using this site

These terms apply whenever you browse titanevo.com or place an order with TitanEvo. By using the site you agree to them. You agree not to interfere with the site, scrape it at scale, attempt to access other customers' data, or use it for anything unlawful. You must be at least 18 and able to enter a contract to place an order.

2. Orders and acceptance

Adding items to your cart and paying is an offer to buy, not a completed contract. Our contract with you forms when we email you an order confirmation with an order number. Confirmation of payment by itself doesn't guarantee acceptance.

3. Pricing and availability

All prices are in Australian dollars and include GST where it applies.
Free standard shipping applies Australia-wide; Priority Express is $6.95.
Prices, bundles and promotions can change at any time, but never after your order is confirmed.
Stock is limited and not reserved until checkout completes. If an item sells out after you order, we'll tell you and refund or substitute with your agreement.
Product photography is representative. The sea animal inside each bomb is random, so the figure you receive may differ from the one pictured.

4. Our right to refuse or cancel

We may refuse, limit or cancel an order — before or after confirmation — where there's an obvious pricing or listing error, where stock isn't available, where we suspect fraud, resale or coupon abuse, where the delivery address is outside Australia or is a freight forwarder, or where we can't verify the payment. If we cancel an order you've paid for, we refund you in full to the original payment method. That's the extent of our liability for a cancelled order.

5. Delivery, returns and the guarantee

Delivery timeframes are on our shipping page and are estimates, not guarantees, because the last leg is with a carrier. Returns, refunds and the 60-day Happy Bath Guarantee are governed by our returns policy, which forms part of these terms.

6. Safe use of the product

You agree to follow the safety information on our ingredients and safety page: suitable for ages 3 and up, the hidden toy is a small part and a choking hazard, not for children under 3, and adult supervision is required in the bath.

7. Intellectual property

The TitanEvo name, logo, product designs, packaging, photography, illustrations and site copy are owned by us or licensed to us. You may share links and screenshots for personal, non-commercial use. You may not copy our copy, imagery or branding for commercial purposes, or use them in a way that suggests we endorse you, without written permission. Reviews and photos you send us may be used in our marketing unless you tell us otherwise.

8. Disclaimer of warranties

Except for the consumer guarantees described below, the site and its content are provided "as is". We don't warrant that the site will be uninterrupted or error-free, and product information — including the effect on bath-time behaviour — is offered in good faith rather than as a clinical or medical claim. Nothing on this site is medical advice; talk to your GP or pharmacist about your child's skin.

Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You're entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. Nothing in these terms excludes, restricts or modifies those rights. Where we're permitted to limit a remedy, our liability is limited to replacing the goods or refunding what you paid.

9. Limitation of liability

Subject to the section above, our total liability arising from your order or your use of this site is limited to the amount you paid for the relevant order, and we're not liable for indirect or consequential loss such as lost profits or loss of data. We're not liable for delays or failures caused by events outside our reasonable control, including carrier disruption, natural disasters and network outages.

10. Governing law

These terms are governed by the laws of Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Australia and of the state in which our warehouse operates.

11. Changes to these terms

We may update these terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order, so changes are never applied retrospectively. The "last updated" date above tells you when we last revised them.
